Terms of Service

These Terms of Service ("Terms") govern your use of this mobile game (the "App") and the website oust-game.eu (the "Website"), published by Vapolia. By downloading, installing or using the App, you accept these Terms. If you do not agree, please do not use the App.
1. The service
This game is a board game offering local single-player and online multiplayer modes. Some features require an internet connection and a sign-in through Apple Game Center or Google Play Games.
2. Eligibility and accounts
You must be old enough to enter into a binding agreement and to use the relevant app store and sign-in services in your country. You are responsible for keeping your sign-in credentials and device secure, and for activity carried out through your account.
3. Licence to use
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the applicable app store rules.
4. Acceptable use
When using the App, and in particular online multiplayer, you agree not to:
- cheat, exploit bugs, or use unauthorised software, bots or automation;
- choose a display name or send content that is unlawful, offensive, harassing or that infringes third-party rights;
- disrupt the service, other players, or the underlying infrastructure;
- attempt to reverse engineer, decompile or circumvent technical protections, except as permitted by law.
We may suspend or terminate access to online features in case of breach of these Terms.
5. Intellectual property
The App, the Website, graphics, rules presentation and software are protected by intellectual-property rights and remain the property of Vapolia or its licensors. These Terms do not transfer any such rights to you beyond the licence granted in section 3.
6. App stores and third parties
The App is distributed through the Apple App Store and Google Play. Your use is also subject to the terms of those stores and of the sign-in providers (Apple, Google). We are not responsible for those third-party services.
7. Availability and changes
We strive to keep the service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue all or part of the App or its online services, and may update the App, at any time.
8. Disclaimer of warranties
To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied. This does not affect the mandatory legal guarantees you may have as a consumer under applicable law, including French law.
9. Limitation of liability
To the extent permitted by law, Vapolia shall not be liable for indirect or consequential damages arising from the use or inability to use the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Personal data
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
11. Governing law and disputes
These Terms are governed by French law. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence in the EU. You may use the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr. Failing an amicable solution, the competent courts shall be determined according to the applicable rules of jurisdiction.
